TEACHER COUPLE WHO HAD THREESOME WITH A STUDENT WON'T BE CHARGED

Accused: Bambi Dewey, 32, and John Stalmach, 31, will not be charged with having sex with the student, 16, but misdemeanor charges may be pursued 

Two teachers accused of having a threesome with a 16-year-old female student will not be charged after prosecutors found they had not violated any of the laws they were accused of breaking which included soliciting a minor and sexual conduct between a teacher and student.

Clark County School District teachers John Stalmach, 31, and Bambi Dewey, 32, from Las Vegas, were arrested in September after it was discovered the couple had been having three-way sex with a student.

But last month prosecutors dropped the charges against the couple after finding that it was the teen who was the initiator of the sex, that she was the age of legal consent under Nevada law and that she did not attend the same school the teachers worked in when the incident happened.

District Attorney Steve Wolfson said: 'As much as I was personally troubled by their conduct, we can only charge what we can prove beyond a reasonable doubt in court.'

Misdemeanor charges may be pursued, according to the Las Vegas Review Journal.

The Las Vegas Sun reported in September that the Basic High School student initially denied having sex with her teachers before later admitting that she was too embarrassed and afraid of her parents' reaction.

She said she started seeing the teachers outside of school hours including babysitting Dewey's children and spending the night at their home where they would drink shots of whiskey and smoke marijuana before engaging in three-way sex.

The pair initially denied having any sexual relationship with the student and denied giving her alcohol or marijuana but eventually confessed.

The teachers were suspended without pay after their arrest and it is not known whether they will be allowed to return to teaching.

In 2009, Stalmach was accused of improprieties with another freshman girl at Basic High School.

According to the police report, Stalmach was accused of texting a freshman and showing her pornographic pictures, although an investigation produced no evidence and Stalmach was not charged.

Instead, he was transferred to Daily Elementary School, where he is currently a physical education teacher.

Both teachers have been Clark County School District teachers for the last five years.
